In a significant ruling, the Patna High Court has mandated the immediate removal of an AI-generated video created by the Bihar Congress, which shows Prime Minister Narendra Modi's deceased mother, Heeraben Modi, scolding him in a dream.

A division bench, led by Acting Chief Justice P. B. Bajanthri and Justice Alok Kumar Sinha, issued the directive to major online platforms, including Meta, Google India (YouTube), and X (formerly Twitter), instructing them to take down the video and prevent its future dissemination.

The court's decision followed a Public Interest Litigation filed by advocate Vivekanand Singh. Singh contended that the video was a "disgraceful, dishonouring, and distasteful" violation of the dignity and privacy of the Prime Minister's late mother. He cited key Supreme Court precedents, such as the KS Puttaswamy and NALSA Foundation cases, to support his argument that the content infringed upon fundamental rights.

The petitioner also pointed out the video's release during Pitru Paksha, a time of ancestor reverence, which he argued made the act even more insensitive. Additionally, he claimed the video falsely criticized government policies, like demonetization, despite the Supreme Court's validation of the policy.

Considering these points, the court ordered the video's removal and issued notices to several parties, including the Union and Bihar governments, the Bihar Pradesh Congress Committee, the Election Commission of India, and Congress leader Rahul Gandhi, requesting their replies.

This judgment highlights the judiciary's growing concern over the use of AI in political campaigns, particularly its capacity to damage reputations, mislead the public, and infringe on personal dignity.
