Birth and Death Registration Rules Tightened; New Law Takes Effect October 1
New Delhi, September 17: The Registration of Births and Deaths (Amendment) Act, 2026, will come into force on October 1, introducing stricter scrutiny for delayed registrations, including a judicial magistrate’s order for cases reported more than two years after the event.
Registrar General of India Mrityunjay Kumar Narayan announced the commencement date through a gazette notification, PTI reported. The legislation received presidential assent in August after being passed by both Houses of Parliament.
Under the amended provisions, a birth or death reported after one year but within two years may be registered only on an order from the District Magistrate, Sub-Divisional Magistrate, or an Executive Magistrate authorised by the District Magistrate.
For events reported after two years, registration will require an order from a Judicial Magistrate of the First Class.
In both categories, the authority must have jurisdiction over the place where the birth or death occurred and verify the correctness of the information before allowing registration. Applicants must also pay the prescribed fee. These requirements are set out in the 2026 amendment bill.
The changes aim to encourage timely reporting and strengthen checks on delayed applications. Registration of births and deaths is compulsory under the law, and the certificates serve as legally admissible evidence of the respective events.
