No CCTV, No Clarity: Court Questions Legality of Police Station Actions

New Delhi, March 27: In a sharp observation that raises serious concerns over police accountability, the court has questioned whether actions carried out inside a police station can be considered lawful if mandatory CCTV cameras were not installed or functioning.

The issue revolves around earlier directions issued by the Supreme Court, which made it compulsory for all police stations and investigative agencies across India to install CCTV cameras to ensure transparency and protect citizens’ rights.

During the hearing, the court pointed out that CCTV surveillance is not just a procedural formality but a critical safeguard. It helps verify what actually takes place inside police premises, especially during interrogation or detention. In the absence of such recording, establishing the truth becomes significantly harder.

The judiciary has repeatedly emphasized that CCTV cameras must be installed in all key areas of police stations — including entry and exit points, lock-ups, corridors, and interrogation rooms — to prevent misuse of power and custodial misconduct.

The court further noted that merely installing cameras is not enough. They must remain functional at all times, with proper maintenance and data storage systems in place. Any failure in this regard weakens accountability and raises doubts about the legality of actions carried out inside such facilities.

This concern gains importance in light of multiple cases where missing or non-functional CCTV footage has made it difficult to verify claims of misconduct or illegal detention. Courts have stressed that such gaps can directly impact the protection of fundamental rights, including the right to life and personal liberty.

The latest observation sends a clear message — compliance with CCTV guidelines is not optional. It is an essential requirement to ensure transparency in policing and to uphold the rule of law.

As scrutiny over law enforcement practices grows, the spotlight is now on authorities to ensure strict implementation of these directives, leaving no room for ambiguity in matters of justice.
