The Supreme Court’s ‘Old-Fashioned’ Remark Sparks Debate During Bail Hearing in Marriage Promise Case

New Delhi, 16 Feb : The Supreme Court of India made some noteworthy comments about physical relationships before marriage while considering a bail application tied to an alleged false promise of marriage.

A Bench led by Justice B V Nagarathna and Justice Ujjal Bhuyan noted that while the court might seem “old-fashioned,” it’s important to remember that two people are essentially strangers before they tie the knot. The judges urged individuals to be cautious and not to place blind trust in someone before entering into a marital commitment.

The case revolves around a woman in her 30s who reportedly met the accused through a matrimonial website back in 2022. Allegedly, the man built a relationship with her in Delhi and later in Dubai, promising that he would marry her. It was also claimed that he recorded private videos of her without her consent and threatened to share them.

The woman eventually found out that the accused was already married and had entered into another marriage on January 19, 2024. During the hearing, the court raised questions about the circumstances that led the complainant to travel abroad to meet him before marriage.

The Bench hinted at the possibility of mediation and mentioned that the case would be revisited to look into further developments. Previously, both a Sessions Court and the Delhi High Court had denied bail to the accused, stating that consent obtained under the guise of a marriage promise, if made without genuine intent, might not be legally valid.

These remarks have sparked a conversation about consent, trust, and accountability in relationships formed through online matrimonial platforms.
